Dear Bargaining Unit Members,
I regret to inform you that the Court of Appeals for the DC Circuit has denied POPA’s petition for rehearing and for rehearing en banc in the 2003 Millennium pay case. The only course of action at this point is appeal to the U.S. Supreme Court and that appears on the surface to be highly unlikely. Right now there is no clear rationale for POPA to appeal to the Supreme Court and the decisions of the DC Circuit would make it virtually impossible to go forward with the 2004, 2005 and 2006 grievances.
Sorry to be the bearer of this news. It is very sad to me that this agency appears to have been successful at effectively denying almost $100 Million in back pay and interest from thousands of dedicated employees over the last ten years.
